I am taking claw1001 Business Law and I have a problem based assignment.
Can anyone help give advise for QUESTION 2 regarding NSW contract law.
Assignment problem question: It was the height of summer in a time before social distancing: eleven o'clock on a balmy Friday night in late January 2020. Crowds of people wound their way through busy city streets: flushed faces lit by the glittering lights of the harbour. refracted off the thick bushfire haze hanging low in the air. The noise was deafening inside PinStrike Bar and Bowling Lounge; a cacophonous blend of thumping bass. bowling pins scattering and the shrieks of people partying as if it would be their last time for many months which. although nobody knew it just yet. lt would. Over on lane 11. Erika Ying was celebrating the deal ofa lifetime. During her final year of a Business and IT degree in 2019, she had created an app called Click Clock a beautiful yet simple platform revolving around clicking a different selfie for each hour around the clock. The app had taken off. launching the careers of a thousand tween influencers. and had recently been bought out by tech conglomerate Googlassian for an eightfigu re sum. In the opposite lane. Tyler Tagler had two reasons to celebrate. It was his twentieth birthday. which meant {as he made sure everyone within earshot knew beyond any doubt} that in just one year he would come into his inheritance: a stake in the family business. Tyler's mother Clementine, a shrewd investor and businesswoman. had worked hard throughout her life and over the years she had amassed a sizeable portfolio of properties and entertainment venues across Sydney. including PinStrike itself. which she had promised to give to Tyler when he turned twentyone. \"Yeah. you heard right'. Tyler said. to everybody and nobody in particular. \"All of you lot will be working for me soon. so pour me another one!" OverhearingTyler, Erika immediately saw an opportunity to network with another successful young entrepreneur. She approached Tyler and introduced herself. Tyler, who had never been much of an influencer himself. jumped at the opportunity to post a midnight Click Clock with the app's own founder. However, over the next hour or so. their conversation was all business. as they discussed growth hacking. cryptocu rrencies. viral marketlng strategies, and disruptive technologies. Each was just a little bit jealous of the other. Tyler. it seemed, had a real business. with real people coming through the door to buy a tangible service something which Erika would never have no matter how viral the app. Erika. on the other hand, was everything Tyler was not selfmade, not tied down to the family empire. and with some hard cash to burn. The solution. it seemed was obvious 7 though. later on. neither Erika nor Tyler would recall just who exactly made the offer first. The proposed terms. however. were undisputed: that Erika would purchase PinStrike in six instalments of $100,000 to be paid each month. which would give Tylerthe capital to start his own side pursuits away from the family business. Their school rugby team had just won the local interschool cluster tournament and everyone was in good spirits. Zane, however, was paying less attention to bowling; instead trying to get the attention of Ramona Ouinn. the sultry. greenhaired bowling attendant who had set up their lane. \"Hey Ramonal', Zane called. Hearing no response, he shouted \"OH!" and dropped his bowling ball on the ground, where it landed with a resounding thud. Cursing the fact that her name was written on her badge, Ramona came over to Zane's group and fixed him with an icy stare. 'Can lhelp you?', she asked. There was a blinding flash as Zane whipped out his phone and posed for a selfie with Ramona, quickly posting it to his Click Clock. Shaking her head. Ramona turned and walked away in disgust. In her haste to get as far away from Zane as possible, she failed to notice the uneven and cracked floorboards at the start of the lane. which had been made worse by Zane dropping the ball on the very same spot earlier. \"Oi Ramona I'm gonna get a strike. just watch me, l'mma knock 'em all down for you!" shouted Zane. He took a huge runup and hurtled towards the lane. catching his foot on the cracked floorboards. It was over in a second. The only thing louder than Zane's high pitched squeal of agony was the roar of laughter from his friends. Advise all relevant parties on the following. Discuss issues relating to the lavvr of contract or negligence only. 1. Zane has suffered horrific injuries a broken pelvis and femur which will take months to heal and cost many thousands of dollars in medical expenses. Zane's mother Xara arrives at his hospital bed and is so distraught at the sight ofthe surgical pins and splints that she vows never to let Zane out of her sight again. Weeks later, she breaks down in tears if Zane even leaves the room for more than a minute. Zane feels trapped he can no longer hang out with his friends and his dreams of playing rugby for the Bulldogs are over. {10 marks) 2. Erika transfers to Tyler the first instalment of her purchase of PinStrike the next day after being assured by Tyler that Clementine will be supportive of their arrangement. Although both Erika and Tyler make appointments to see their respective solicitors to formalise the deal, life seems to get in the way. Erika pays a second instalment in February. Both times, Erika receives an email from Tyler and Clementine Tagler' acknowledging receipt of the payment soon afterwards. Everything changes, however, in March 2020. The global outbreak of COVlD19 forces PinStrike to close and lay off all its workers. Erika approaches Tyler and Clementine to try to get out of their deal but her pleas fall on deaf ears. \"A deal is a deal the proof is all over the lnternet!'.
