Use IRAC Approach Facts: Jack left Whitman and was running down a step just outside the building when he fell and struck his head on the pavement. Jack would later learn that step was in violation of the building code because it was sloped down and not level. iack decided that he should walk to the hospital. As he was walking by an older building owned by SU there was a dynamite explosion that SU had planned and conducted in orderto demolish the building. When the dynamite exploded, a piece of the building hit jack and severely injured his arm. At this point, Jack was on the ground waiting for an ambulance to be called. A friend of Jack's standing near him specifically told Jack to stay on the ground and wait for the ambulance. Rather than just wait for the ambulance to pick him up, Jack decided to get up and try continue to walk to the hospital for treatment. As jack was crossing the street he was disoriented and did not see oncoming trafc. Jack was struck by an SU maintenance truck being driven by an SU employee. The SU truck had the right of way but the SU employee driving the truck was texting on his cell phone right before the accident happened. Jack's two legs were injured in this accident. Jack has filed a lawsuit against SU for his injuries. What will Jack argue against 5U? What will SU argue in defense againstlack's claims. What will the court rule/conclude. Use the facts above to justify the arguments that SU or Jack might make. ISSUES: RULES: ANALYSIS: A. WHAT WlLL JACK ARGUE AGAINST SU 1. FIRST ACCIDENT 2. SECONDE ACCIDENT 3. THIRD ACCIDENT B. WHAT WILL 5U ARGUE ACCIDENT JACK 1. FIRST ACCIDENT 2. SECOND ACCIDENT 3. THIRD ACCIDENT CONCLUSION
