Use the legal principles of the law of agency to answer the following question; Mark. a distributor of fresh fruits, used the services of "Garth the Zipper" to take his fresh fruits from Kingston to Montego Bay, Last week Friday. Mark made a delivery of Fresh strawberries to Garth and the delivery was to take place on Saturday to Mark's customers. Unfortunately, there was a demonstration in Montego Bay which prevented motorists from travelling around Montego Bay on Saturday. Garth attempted to call Mark but was unable to reach him as the phone service kept saying Mark had turned off his mobile or was out of range. Garth left the strawberries at Freshie Food Supermarket and informed the owner that Mark would pay him for storage. The storage cost was $2,000,00 for the night. On Sunday, morning, when Garth checked on the strawberries at the Supermarket, some of them were spoilt, so he sold the spoilt strawberries to Fruity the Smoothie vendor on the Hip Strip in Montego Bay for $2,000.00 and sold the fresh strawberries to the Freshic Foods Supermarket for $30,000.00. He also asked the Supermarket owner Kenneth to store some chicken mixed parts he had and informed him that this would also be paid for by Mark who he had identified to Kenneth as a seller of fresh fruits. Mark called Garth on Sunday evening as he had received calls from the customers that day that they did not receive their delivery. Garth informed Mark of the demonstration and that he tried to reach him and that he had to store the strawberries overnight but they were spoilt so he sold all the simwberries to the Smoothie Vendor for $5,000,00 based on the state of the spoilage. Mark is quite upset and informed him that he will be suing him for the full cost of the strawberries which was $40,000.00 and he was not paying Kenneth for the storage of the strawberries, Mark wanted the number of the person he sold the strawberries to but Garth pretended that he could not hear him and ended the call.
