A potential civil law liability they may face arising out of their own aiken? On January + 2021 Lisa and William opened a new business called Rainworth Mechanics. They had registered that name as a business name and the business was owned and operated using a private company of the same name Le. Rainworth Mechanics Pty Ltd. Liss and WElam were the sole directors and shareholders of this company. On the first day of trading Le. January $:2021 an 18 year old named Peter attended upon the workshop enquiring about a possible job. Peter provided a Certificate IV in Mechanical Studies from the local TAFE college and assured Lisa and William that he was good with vehicles and had a driving licence However, as a Mercaend Peter had served 6 months in a Juvenile Detention Centre for theit As Pater was now if he was determined to turn over a new leaf and make something of his life and did not advise of the offences that led to his time in custody as a child. Lisa and William offered Peter 1 day of casual work and made no enquiry regarding his background other than to confirm with the TAFE College that he did in fact have the Certificate ly in Mechanical Studies. Shortly after Peter commenced work a nearby resident, Bradford, arrived at the workshop in a late model Mercedes sedan. Whist wading at the counter bradford overheard Willam on his office phone discussing share trading with his stockbroker. Bradford heard Walkam confirm the broker's advice to "buy all the WOLF shares as the stock was about in go through the roof, Bradford was an avid share trader himself and made an of what he had ov Willlam served Bradford as soon as the phone call concluded. Bradford wished to have the exhaust of the Mercedes vehicle checked and was advised by Wiliam to park the vehicle at the entry to the first available workshop bay, Bradford did this and then provided a single key to Peter, adding that he would be back at 4:30 that afternoon to collect the vehicle. Peter then parked the Mercedes vehicle over the lifting mechanism of the garages hydraulic mechanical holst. He then returned to the workshop office to discuss the next steps with William Unbeknown to Peter, William & Lise, Bradford then returned to the vehicle and was lying across the front seats searching the floor in an attempt to find his expansive mobile phone. To get started Peter went to the vehicle raised the hoist not realising that Bradford was inside the car. Bradford who is afraid of heights and suffers clause mmenced yelling and screaming from the cabin of the car and demanded for the vehicle to be lowered. Peter attempted to lower the hoist, but only managed to rabe it even higher and in trying to resolve the problem the holst became jammed and would not move] Page 1 of 2 Upon hearing Bradford's wild screams William called both the fire brigade and a hydraulic hoist technician in an attempt to have the hoat lowered. The fire brigade and the hoist technician arrived after about 20 minutes and shortly after that a news crew with a camar an alto showed up. Without too much further difficulty the vehicle was bounced and Bradford released, Bradford remained in an angry and agitated state telling the news crew that "this place is run by crooked fools who nearly killed me" adding whist pointing toward Peter "the young bloke even stole my mobile phone, I'm out of here Bradford then walked furiously towards his vehicle, got in and commenced revving it very loudly Bystanders then wi nessed the vehicle jok forward and crash into William's very expensive electronic turning equipment. Bradford, who was not wearing a seat belt was thrown forward into the windscreen of the vehicle and received a cut above his left eyebrow but was otherwise uninjured. The damage caused to the vehicle was $30,000.00 and the electronic equ pent, valued at $80,000.00 was unable to be repaired Bradford, holding his bleeding eyebrow ran from the workshop screaming "I'll see you crooks for this!!" The news crew captures this footage, which is replayed on the evening news. After arriving home via Uber and in a bloodied state bradford frantically calls his gir demanded that he purchase $15,000.00 worth of WOLF shares immediately. He also calls the local police and makes a formal complaint alleging that Peter stole his mobile phone valued at $1,200.00. Later that afternoon the police arrived and took Peter in for questioning in respect of the alleged theft of Bradford's phone. Peter denied the allegations and bugged the police to dial the number of the allegedly stolen phone. Eventually the detective phoned the number and the phone was answered by Rossanna, the owner of a virtual gaming centre. Roseanne tells the police that the phone was left at the club a couple of nights ago and that she had answered the phone yesterday when a female called the number looking for her husband "Bradford". Roseanne also tells the police that she told the female caller where the phone could be collected but so far no one had come to collect it. Police then advise Peter that he is free to go and that there will be no further steps taken in respect of Bradford's allegations. The entire incident at the workshop is replayed on the evening news including all of the comments made by Bradford. Later in the evening the pole-brofee calls Bradford and confirms that he purchased the WOLF shares as requested but the share price had fallen by 95% at the dose of trade, adding that WOLF was thought to be on the verge of insolvency.
