Hypothetical Fact Summary #2 Mark loves to spend lots of time on his android cell phone accessing social media sites, including Facebook, Instagram, and TikTok. He is a big fan of Google and has a Google account which he accesses on his cell. Mark always has his cell phone with him. One day Mark went to meet his friends at the track and field area of the nearby university. As he drove into the university parking lot, he noticed a man changing into a Kevlar vest and was dressed all in black in a vehicle parked nearby the university administration building. At the time, he thought it odd to see someone dressed like that in the university parking lot. Mark did not want to draw attention to himself, so he pretended to take a selfie to capture a photo of the man dressed in black. The man in black started his car and exited the parking lot right after Mark had taken the photo. Mark then uploaded the photo to his Instagram account asking if anyone else had seen the man in black. Mark went to the track and field area where he met his friends and shared with them about the man in black. Shortly after he met his friends, Mark received an alert on his phone about an active shooter in the area. In the days following the event, the police were able to identify potential witnesses from electronic data they received from Google's location history function, discovering Mark may have been in the shooter's proximity. A police officer then reached out to Mark about the event. During his conversation with the officer, Mark told the officer about the man he saw and the photo he posted to his Instagram.
