"Viral" Social Media NOTE: DO NOT ASSUME THAT THE FOLLOWING IS BASED ON COVID-19. ANY SEMBLANCE TO REAL PERSONS OR EVENTS IS ENTIRELY COINCIDENTAL. During a widespread viral pandemic, the President issues an executive order that states as follows: "Due to the threat of airborne transmission of the virus, all employers within the United States must require employees in the workplace to wear facemasks, and must also complete daily blood testing of employees for infection. This order is necessary to protect the public health because Congress has refused to take action to address the matter." In response to the President's executive order, the legislature of the state of West Virginia passes a bill stating, "No employer shall mandate that employees wear facemasks or the complete medical testing for viral infection unless there is a known workplace exposure." The governor signs the bill into law. Curt owns a bicycle shop, called "Curt's Cruisers, LLC," in West Virginia. Curt encourages his employees to build friendly relationships with customers, stressing the importance of customer loyalty. His best salesman, Alex, is well-known in his local community due to his social media activity, which includes both political activism and advertising for the bicycle shop. Alex has cultivated a loyal customer following through his social media contacts. Alex is not a fan of the President's executive order. He begins to make social media posts critical of the President's executive order, calling it "fascism," and he shares doctored photos of the President in Nazi garb. Alex encourages his followers, including customers of Curt's Cruisers, to ignore the mask mandate. Alex shares medical studies showing that wearing a mask dangerously restricts oxygen intake. Instead, Alex urges people to buy bikes, because regular exercise strengthens the immune system in response to the virus. Alex tells Curt that he will not wear a mask while working, and that he also will not submit to the blood testing. When confronted with the requirements of the executive order, Alex responds that it is a violation of the West Virginia statute to require him to do so. The next day, several local health department officials appear at the Curt's Cruisers shop. They tell Curt that unless he terminates Alex, they will fine the business $100.00 per day for violating the President's executive order for allowing Alex to work without masking.
