Wade Garrettis completely blind. He relies on software to read aloud text that appears on computer screens. He intended to use this software to attend ScaliaLaw School (SLS), which is entirely online. After being accepted, Waderealized that some of the school's online materials could not be read by his software. There is available software that would enable all of SLS's materials to function with this assistive software, however, the school refuses to change it's website. Wadeis initiating this suit under the Americans with Disabilities Act (ADA), 42 U.S.C. 12182. Wadeclaims that SLShad discriminated against him by failing to provide him with reasonable access to the website. SLSmoves to dismiss on the grounds that online schools are not covered by the ADA. This court must resolve the issue of whether online schools fall within the scope of the ADA.
