Week 10 Revision: Additional Practice Questions CI Questions on Contracts Law 1. West parked his car in a carpark owned and operated by the council. The attendant gave him a ticket with the time of arrival stamped on it. Later in the day a person calling himself 'Paul Robinson' told another attendant that he had lost his ticket and gave a number of a car which bore no relation to the number plate on West's car. The attendant thereupon issued him another ticket which was use dot drive West's car out of the car park. West returned to find his car missing. The vehicle was later found in a badly damaged state. West sued the council which sought to rely on an exclusion clause on the back of the ticket given to West earlier in the day. The clause read as follows: 'The council does not accept any liability for loss or damage to any vehicle or damage to any article or thing in or upon any vehicle or for any injury to any person, however such loss, damage or injury may arise or be caused'. Discuss if the exclusion clause absolve the council of liability
