After a discussion with Ms. Taylor, she indicated that Ms. Taylor determined to move forward with the negligence lawsuit against Miller's Fun Park. The Managing Partner has asked you to draft the documents described below in connection with this negligence lawsuit.You may make up the addresses of the parties to the lawsuit.

  • Complaint: The Managing Partner asked youdraft a complaint for her signature to initiate the negligence lawsuit against Miller's Fun Park. For the purposes of the Complaint, the venue should be in Monroe, Louisiana.The Complaint must contain the following items/components at a minimum: (1) caption; (2) factual allegations; (3) cause of action for negligence; and (4) wherefore clause. Be sure to address each element of negligence in the complaint (duty, breach, causation and damages).
  • Request for Production of Documents:The Managing Partner indicated that she would like to get an early start on discovery in connection with the negligence lawsuit. To that end, she asked you to draft a Request for Production of Documents. A Request for Production of Documents is a discovery document used to request documents, electronic data, and physical items held by an opposing party in a legal matter. The Managing Partner indicated that she willserve this document to Miller's Fun Park's attorneys. The Request for Production of Documents must list at least five (5) documents that you think wouldhelp us to gain insight into any relevant evidence that Miller's Fun Park has related to this negligence matter.
