- Plaintiff took his BMW car to Defendant's facility in Northern California for an oil change.
- Defendant's mechanics recommended additional repairs, including replacing all parts for the front and rear brakes and performing a 60,000-mile maintenance service. Plaintiff agreed to these repairs, which totaled $3,248. Of that amount, the brakes cost $1650. He paid by check.
- Plaintiff paid for the repairs by check and received a "lifetime guarantee" on the brake parts and a 30-day workmanship warranty for all labor performed by Defendant.
- On February 5, 20xx, Plaintiff and his girlfriend Patricia began a trip to Nevada. Approximately 45 miles into Nevada, Plaintiff noticed that the car was not running properly, and the brakes were squeaking and grinding.
- Plaintiff contacted Defendant and was advised to bring the car back for inspection. However, there were no Danfield's stores in Nevada; so, Plaintiff went to Derek's Car Repair which is incorporated in Nevada.
- Derek the owner told Paul that he did not work on BMWs, but Paul explained that we just wanted to make sure the care was safe. Derek looked at the brakes and said that he did not see anything out of the ordinary and that the brake noises could just be the new brake pads settling in.
- Paul headed back to California, but in Lake City, California, the car began to overheat, lights on the dashboard began to flash, and while trying to get off the road, he slamedon the brakes. The brakes failed, and the car flipped over.
- Paul and his passenger Patricia were both hospitalized with injuries to their backs, necks and faces. Additionally, Paul suffered a broken arm and hand. He required physical therapy and suffered on-going / permanent pain and suffering. Additionally, he lost his job that paid $85,000 per year.
