What are the policy justifications for regulating all wetlands and endangered species at the federal level? If an endangered frog species is found only in the middle of Nebraska, why should the federal government decide whether and how to protect the frog? Similarly, if there is an isolated wetland in the middle of a large ranch in Wyoming, does the federal government have an interest in regulating it? Even if the federal government has an interest in the protection of such species and wetlands, do states have a greater interest in the protection of such species and wetlands, do states have a greater interest in being able to decide how land within their borders should utilized?
