Iegislating criminal law. Principle one states "The enactment of a law requires a commitment to provide the resources and the will to enforce that law, "(Del Castillo, p.13, 2019). Law enforcement does not have the resources to properly enforce laws and keep citizens safe which can lead to high recidivism rates and the continuation of mass incarceration. Implementing more regulatory criminal laws also leads the country in the wrong direction due to the fact that more officers are placed in lower class/minority communities which can lead to racial profiling and unnecessary arrests; creating a more unjust criminal justice system and increasing mass incarceration rates as well as cascload rates for prosecutors and judges. An altemative to our current system of justice is rehabilitation programs to help deter offenders from a possible/current life of crime. People who suffer from drug addiction, alcoholism, or mental illness do not need to be in jail or prison, they should reccive the proper help they need through rehabilitation. Homeless people are being arrested for sleeping on the street, instead they should be placed in a shelter. "Literally millions of people with criminal records will not be able to reach their full potential" (Del Castillo, p. 205, 2019), this is due to criminal gang involvement and the lack of employment opportunities for people with criminal records. Providing more resources and establishing different types of rehabilitation programs can allow for individuals who committed less serious crimes to deter from it and be able to do better for themselves and their families and break the cycle of crime, poverty, and discase. 2) Even though legislators are "not directly responsible for the enforcement or outcomes of their laws," they are in control of creating them. (p 197) I believe that they are costing society greatly, thus the undesirable outcomes we oxperience. Law enforcement requires resources, and if those resources are distributed too thinly as they already are, our judicial system starts to fall apart. Crime will inevitably nise if there aren't enough police to enforce all the laws, judges, and prosecutors to hear cases, and resources for efficient detention and rehabiltation of prisoners. Therefore, these legislatures may deem certain laws necessary because they feel their mindset is in the right place (to protect the people), however, lit does not directly mean that people will not commit the crimes. More laws, means more arrests and a continuation of disparities and an unjust system. Alternatives to our current system of justice are diversion programs. Diversion programs are frequently administered by the legal or law enforcement systems, that allow the offender to escape prosecution. and include a rehabilitation program to help them stay away from crime in the future. Due to lack of resources and overpopulation, if there are opportunities of rehabilitation for crimes such as prostitution. then those who are equipt for these programs should get the opportunity rather than going through the incarceration process. 3). Overall, is the country going in the right direction when it comes to legislating criminal law? Explain your answer. Of course this country needs laws but changes need to be made when it comes to some regulatory criminal laws, some traffic violations and health regulations. Ive always said that the government shouldn't be in charge of how people want to live their lives if it isn' affecting anyone else. That's why I feel that some regulatory cnminal laws should be revised. Things like drug use, prostitution, traffic violations like wearing a seatbelt, foodregulations and drinking alcohol shouldn't be enforced by the law. If a person wants to have sex in exchange for money who are we to judge? Everyone have different morals and values so we shouldn't judge whose is night or wrong. The govemment should not force people to wear seatbelts or regulate our eating habits such as calories intakes and food restrictions. They should educate us to understand the nisks but it should be up to ourselves to decide. The same should be said for drinking alcohol and using recreational drugs. Of course driving under the influence of alcohol or drugs should still be enforced by the law because they are puthing others on the road at nisk but recreational drug and alcohol use at home during their personal time shouldn't. I feel that the governmen needs to work on these things to lead us in the right direction. Given existing social problems such as drug addiction and disregard for certain laws and efforts to defund police departments, what are the alternatives to our current system of justice? As stated before jails all across the country are overpopulated. Court houses are filled with defendants who are facing a judge for minor or petty crimes. Drug possession should not be a crime because those people have an addiction and need help so going to jail is pointless. They should be referred to a progra to help them get off drugs. People who were found guilty of minor assaults would benefit from an anger management program along with therapy rather than getting sent to jail which will make them angrier. Major crimes deserve harsh punishments. I feel like many states, especially New York, are soft on a lot crimes. There's no reason a person who was caught shooting at someone should be released from jail immediately for a later court date. That's why the recidivism rate is high because people feel that they ca get away with crimes. Bail reform definitely needs to be reformed again
