SOUTH CAROLINA DEPARTMENT OF LABOR, LICENSING AND REGULATION BEFORE THE SOUTH CAROLINA STATE BOARD OF FUNERAL SERVICE FINAL ORDER The above-captioned cases came before the South Carolina State Board of Funeral Service ("Board") for a Final Order hearing on April 26, 2023, regarding the Memorandum of Agreement and Stipulations ("MOA") signed by Responding and filed with the Board. In the MOA, Respondents waived formal hearing procedures and elected to dispose of this matter pursuant to S.C. Code Ann. 1-23-320(F) (2005, as amended) in lieu of, inter alia, a formal contested hearing before the Board. A quorum of the Board was present. The hearing was held pursuant to S.C. Code Ann. 40-19-90; 40-1-90, -120, and -170 (2011, as amended); and the provisions of the Administrative Procedures Act, S.C. Code Ann. 1-23-310 et seq. (2005, as amended) to determine what sanctions, if any, were appropriate. Alexis Bell, Esq., Assistant Disciplinary Counsel, represented the State. Respondents appeared by and through Respondent-Embalmer and Ivori L. Henryhand, Respondent-Establishment's manager, and were pro se. After consideration, the Board voted to accept the MOA, with the sanctions specified in this Order. WITNESSES AND EXHIBITS2 The State presented no witnesses. Respondent-Embalmer testified on his own behalf and on behalf of Respondent-Establishment. Ivori L. Henryhand, Respondent-Establishment's manager, also testified on Respondents' behalf. The following exhibit was introduced by the State and accepted into evidence without objection: 1 Respondent Henryhand Funeral Home is referred to as "Respondent-Establishment." Respondent William C. Henryhand, Sr., is referred to as "Respondent-Embalmer." Collectively, they are both referred to as "Respondents." 2 Exhibits referenced herein were identified and admitted into evidence for the Board's consideration during the final order hearing, but are not attached hereto.
