Question 2
Uniformed police officers approach 5 teenagers standing around an automobile and sitting on its hood located outside Pizza 51 (at 51st and Oak Streets). As the officers approached, the teens ran in different directions and the officers gave chase. Officer Johnson was about 20 feet behind Peach when Peach tossed away a packet. A moment later, the officer tackled Peach. The packet was found to contain fentanyl. He was arrested for possession of a narcotic.
Meanwhile, another officer was chasing a second juvenile (Scarlett). When the officer tackled Scarlett, she searched her pockets and discovered a bag containing heroin. Scarlett was charged with possession of a narcotic.
Meanwhile, yet another officer was chasing a third juvenile (White). The officer observed White to be holding onto something tucked into his waistband while he was running. Eventually, White got tired and stopped, and was still holding something in his waistband. The officer conducted a pat-down and discovered a firearm tucked into White's waistband. Possession of a concealed firearm is illegal, and White was arrested. The officer then searched White and discovered fentanyl pills in his pocket. He was charged with possession of a narcotic.
Upon returning to the automobile the officers encountered a fourth juvenile (Peacock). Peacock was acting strangely and fidgeting with something in his jacket pocket. The officer conducted a pat-down of Peacock's outer clothing and felt a baggy in his pocket. After maneuvering the baggy to determine its contents, the officer believed it to contain pills. He entered Peacock's pocket and retrieved a baggy of opioid pills.
The defendants are contesting the introduction of the evidence. How should the trial court rule in each of these cases? (Four separate explanations for the four different in custody).
Peach: fentanyl Scarlett: heroin White: firearm and fentanyl Peacock: opioids
Explain your answer using rules of law and applying the case facts above.
