You should (a) identify the relevant issues, (b) determine the applicable rules and principles from the text, (c) analyze how the rules and principles specifically apply to the given set of facts, and (d) state a concise and well-reasoned conclusion that logically follows from your analysis. BILLY BOB JENKINS HAS LEFT THE BUILDING Charlie and his 19-year-old autistic son Jeff have had season tickets for years to the Winchester Wizards professional football games. They go to the games with a group of other men who are friends of Charlie's. During one of the games, a discussion ensues as to whether Billy Bob Jenkins would ever leave the Wizards as their head coach. It is the third quarter, and all the men other than Jeff have had a few beers too many. Jeff says that he believes Jenkins will leave to return to college coaching if he gets an offer that is appealing to him. The other men laugh at this remark, and there is general agreement among the other men that Jenkins will never leave. Matt, one of Charlie's friends says, "Tell you what Jeff, if Jenkins leaves the Wizards before the start of next season, I'll take you on a trip to England and France for a month." All the men laugh. However, Matt does not laugh, and neither does Jeff. Matt goes on to say, "but you have to agree to mow my lawn free for six months if Jenkins stays." Jeff readily agrees, and the other men laugh again. Charlie tells Matt, "there's no way Jeff is going to mow your lawn for free." Jeff says nothing further. Shortly after the end of the football season, Billy Bob Jenkins leaves the Wizards and takes a job as the head coach of a college team-the Long Beach Tigers. Jeff goes to Matt's house and asks to be taken to England and France as Matt promised. However, Matt says, "Oh come on Jeff, that wasn't a serious offer." But Jeff says that he thought it was serious and that he would have been willing to mow the lawn for six months if Jenkins had stayed. When Matt refuses to schedule the trip, Jeff files a lawsuit for breach of contract. Please comment on the following questions. Assume in your responses that the above verbal exchange between Jeff and Matt does not constitute gambling: 1. Did Matt's offer to take Jeff to England and France meet the requirements of a valid offer? Explain your answer-why or why not?2. If there is a valid offer and a valid acceptance, is there consideration present? 3. Does the fact that Matt was drinking at the time of the offer make any difference as to the legal sufficiency of the offer? Explain your answer. 4. Matt argues that Jeff is autistic, and therefore Jeff does not have the mental capacity to enter the contract. Matt argues that this makes the contract unenforceable. He further argues that he relied on Charlie's statement ("there's no way Jeff is going to mow your lawn for free") to conclude that there was never a meeting of the minds on the terms of the offer because legally Charlie "must have" been speaking for Jeff. Jeff's attorney argues that Jeff does have mental capacity and that Charlie was not really speaking for Jeff. Jeff's attorney goes on to argue that, even if the court believes Jeff did not have the legal capacity to contract due to his autism, that only makes the contract voidable by Jeff, at Jeff's option.
