Caught in the System Caught in the System SCENARIO The problem of bail and the indigent creates many ethical and hard decisions for defendants who are poor. Melissa, a 22-year old woman, was arrested for selling crack cocaine to an informant for the police. Conviction carries a mandatory sentence of 5 years and up to 30 years in prison. Melissa had spent the last 10 days in jail. She had a 2-year old daughter who was being cared for by Melissa's mother, who had taken time off work to do this. Bail was set at $50,000, Melissa did not have the $5,000 (10 percent) necessary to post bail. She would have had to spend the next few months in jail, awaiting trial, or adroit gult and accept the State's plea bargain offer a suspended sentence with 8 years of probation. Her constitutional right to trial was, in effect, never available. She had no choice but to accept the plea bargain agreement and admit guilt (although at trial she would have had a good shot at an acquittal because the State's snitch was not guaranteed to show up to testify).
