A very wealthy and prominent businessman has been charged with trafficking several underage girls and women. He trafficked them for both labor and sex. As he owns several properties throughout the United States, he is facing federal charges. His assistant, Maximillian Smith, is also being charged with several crimes. Although he did not engage in the acts with the victims, Maximillian made the initial contacts and arrangements with the victims. The office has offered Maximillian a plea deal in exchange for his testimony against his former employer. As part of the plea deal, he is to provide the names and contact information for the victims - many of whom live outside of the United States. In order to receive the full cooperation of Smith, he wants to be assured the victims will be safe. He already admitted to his role in a television interview, but he will not testify at trial without these assurances.

Assignment:

Maximillian Smith's attorney has filed a motion to prevent your office from admitting his television interview into evidence at trial. Your supervising attorney has asked you to research whether or not the statements he made in the television interview are admissible. Prepare the first draft of an internal legal memorandum outlining your research and conclusion.

1. Identify the issue that needs to be researched. Do not get sidetracked by collateral issues. Your assignment is to research the admissibility issue presented. There may be other collateral issues, but they are outside the scope of your assignment.
2. Assume Maximillian Smith has no additional outstanding criminal or civil issues.
