You are an insurance broker in the Republic Of Ireland. . One of your long-standing clients is Mr Rashid, whose private car insurance policy was due for renewal. You recommended placing the insurance risk with a different insurer, JNI dac, which Mr Rashid accepted. You informed Mr Rashid of JNI dac's premium. He agreed to pay the premium to the insurer by direct debit and provided his bank account details. Shortly afterwards, Mr Rashid learnt of a family emergency overseas and immediately left the country. However, whilst Mr Rashid was abroad for ten days, you became aware that the direct debit payment had been rejected due to insufficient funds in his bank account. You were unable to contact Mr Rashid about the outstanding payment, despite several attempts. Mr Rashid returned on the 1st May and on the journey home from the airport his car was in collision with, and damaged, a third party vehicle. Following the accident, he checked the insurance position and learnt that the premium had not been paid from his bank account. He attempted to contact you to arrange payment. However, JNI dac had issued a cancellation notice to Mr Rashid on the 29th April, cancelling the policy with immediate effect, due to non-payment of the premium. No motor certificate for the car has been received by Mr Rashid. Mr Rashid seeks your advice regarding the accident and the policy cancellation. a) Identify, with justification, two appropriate obligations relating to Cancellation of an insurance policy in the republic of ireland that JNI dac should have complied with when implementing the cancellation procedure. (4 marks) b) Explain, with justification, two potential options Mr Rashid may pursue in response to the cancellation of his insurance policy by JNI dac. (8 marks) c) Discuss whether JNI dac has any obligation to provide insurance cover for the collision involving Mr Rashid's car
