BNC Ltd has 30 trampolines which can be used, for a fee, by anybody over the age of eight. The
trampolines are set out in an open-plan way so that participants can freely jump from one trampoline
to another. There are no restrictions on which trampoline can be used, but only one person may use a
trampoline at any one time. BNC Ltd employ several inexperienced people to supervise this area.
In addition, there is a coffee shop area for parents and spectators. In the coffee shop area there is a
sign which has the following wording: 'BNC Ltd accept no liability for death or personal injury
howsoever and wherever caused'.
BNC Ltd have asked you to submit the following claims to their insurer:
An injury caused to two children aged ten and six years old, who were using a trampoline at the same time.
An injury to a parent who slipped on a wet floor in the coffee shop area.
An injury to an employee of BNC Ltd who has been accidently knocked over by a child who bounced off a
trampoline.
(a) Explain, with justification, the legal implications of the sign in the coffee shop for both BNC Ltd and
its customers. (8)
(b) Explain the potential extent of BNC Ltd's liabilities for the following physical injuries:
(i) The injury to each of the children on the trampoline. (10)
(ii) The injury to the parent in the coffee shop area. (6)
(iii) The injury to the employee of BNC Ltd. (6)
