The Boston law firm of Crain, Pond & Smite decided to open up a Vancouver, B.C law office and sent two of its senior lawyers, Denny Crain and Shirley Smite, to get the new office up and running.

They also enticed he well known Vancouver lawyer, William Argue, to be their local managing partner. As the new firm needed him immediately, it meant that Argue would have to break his contract with his current firm, Bellow, Argue & Harangue, but for a much higher salary he was more than willing to do so.

In addition to Argue, Denny Crain and Shirley Smite came to work out of the new office for initially to help build up its reputation and they brought with them the well-known litigator, Allan Seaside.

The first order of business was not a court order but the task of setting up the new office and that meant buying desks, computers, staplers and paper clips.Smite recommended to Denny that he confine his efforts to wining and dining local bigwigs. And then she suggested that he should also try to establish relationships with the other two 'necessary evils of business life' besides lawyers. Crain retorted in an indignant manner, "I'm Denny Crain! I don't associate with evil people. I'm on the side of truth, justice and the American way!" With a roll of her eyes, Smite responded, "Denny, first of all we are in Canada now." And then she explained what she meant by the necessary evils of business life.

Later, Crain returned to the office and reported that he had met with a number of local accountants and bank managers. And then he said, "And I've still got it!"Smite said, "I just know I shouldn't ask but what is it that you've still got? Denny replied, "Animal magnetism. I met with the Manager of the Humongous Bank and I'm suggesting that we should develop a working relationship and the next thing I know she says she wants to start scratching my back! I hardly know the lady." "Denney," Shirley asked, "Did the bank manager perhaps say 'I'll scratch your back if you will scratch mine'? Crain replied, "That's exactly what she said!" Once again, Smite had to explain to him that the phrase meant the bank would refer some of its client to the law firm, if the law firm referred some of its clients to the bank.

Later that day, Smite and Argue met to discuss the setup of the office. Smite said she went on-line and found that the Buy More website was advertising computers for $499.99. So she bought five using the businesses' charge card. Then she decided to buy five more but the website refused to allow her to do so. When she called to complain, the manager of Buy More said the price was a mistake and the computers were actually $899.99 each. So, they were refusing to send the first five and would not accept any more requests on-line. Argue explained the B.C. law on this.

Argue then said that a package of 100 legal pads, 300 pens and 25 staplers had arrived with an invoice for $875.00. The cover note said, "We heard that you were opening a law office. Here are some essential supplies. If you need them send the invoice amount. If you do not want them, then return the goods within one week. If you do not return them within one week you are required to pay the full invoice amount." Shirley said that she had not ordered them so Argue said he would send them back.

Despite these earlier problems, the Vancouver office of Crain, Pond & Smite was soon open for business. The first client through the door was Ronald Round who owned and operated the Marble Manufacturing Company. Argue went to meet him in the lobby but got there just in time to see him inadvertently bump into another prospective client, Thelma Thunk. She said, "You clumsy oaf." Then she took a swing at him with her umbrella. Despite being rather over-weight, Mr. Round jumped out of the way of the umbrella. Then he began to dance around ducking to the right then weaving to the left, all the while exclaiming that he knew karate. Theodore Thunk, Thelma's husband and a former linebacker for the B.C. Lions, stood up and hit Round with a punch to the chin crumpling Ronald like a deflating balloon.

Crain saw the debacle as he walked into the reception area. So, he asked The Thunk's to leave. Thunk said, "Who's going to make me?" and advanced menacingly toward Denny. Not the least bit apprehensive, Crain replied, "Mr. Smith and Mr. Weston, that's who." And he drew a Smith & Weston revolver out of his jacket. The Thunks made a hasty retreat out the door but not before Thelma yelled out for all those waiting clients to hear, "All you lawyers at Crain, Pond & Smite are crooks anyway! We're going to the law firm of Rush, Rush & DeLaye!" Crain yelled after them, "That firm is full of incompetent buffoons!" Ronda Rush just happened to be entering the office and said, "I'm going to sue you, Crain!" Denny laughed and said, "See what I mean? You are incompetent and what I said was just an insult. So, you don't have the two requirements to even commence a court action." Rush was enraged and turned to leave. She opened the wrong door by mistake, and marched into the coat closet, slamming the door behind herself. The door jammed and Rush began to yell for someone to let him out. At this point Crain was helping Round up off the floor when the receptionist asked what she should do. Denny replied, "Find the building custodian to get him out. Maybe by that time Ronda will have calmed down a bit."

Later in the afternoon, the office was abuzz regarding Bellow's threats to sue Crain.But junior associate, May I. Sue had her mind on other issues as she had just met with a new client, Wanda Wanderer, who given notice and left her position as a Product Purchaser for Staplers, to go and work for the Office Store for more money. Wanda took with the Staplers' list of Suppliers and the discounts Staples provided them because it would help her at her new job. When Sue asked her, Wanda said she vaguely remembered that when she was hired by Staplers she signed an employment contract with a clause in it to not allow this. Wanderer and her new employer were being sue by Staplers. May Sue asked a senior litigator with the firm, Allan Seaside, to explain what that clause might be and how the courts interpret them as it seemed to her that it would lessen competition. Seaside explained it to her and after thanking him, Sue walked away wondering what if any defence her client might have. She wondered aloud, "Maybe our best course is to offer some money and try to ....After all, that is what happens in most civil lawsuits."Her mutterings, however, were lost in the constant cacophony of clicking computer keys as the support staff pounded out plenty of particularly perfect plaintiff pleadings.

Ben Beekman had been trying to sell his car for months and was extremely frustrated. He yelled, "I think I'll give the darn thing away!" His sister, Brenda Beekman, said, "Give it to me." Throwing up his hands, Ben exclaimed, "Why not!". Brenda jokingly ask for the offer in writing. Ben wrote the following:

When he still refused to give her the car, Brenda came to Crain Pond & Smite to sue him.
