You know that Jimmy L. has had a problem with taking drugs, and you are also aware that he is covered under the ADA as long as he is in counseling and taking action to deal with his situation. One of the reasons you hired him is that he could be in a good position to provide counseling to homeless addicts who come to your agency for health services.  Recently, a staff member has informed you that she has seen him drinking at lunch.  You have no other corroborating evidence.  You are concerned that if the situation is true, he could be impaired in performing his counseling responsibilities.
