Jenny works as an accountant at Queensland Films (QF), a film production company on Queenslands Gold Coast, whose manager is Greg. One of the other employees, Charlie, who is Gregs cousin, greatly enjoys Jennys company, and touches her hair and puts his arm around her waist at every opportunity. Jenny greatly dislikes this, and has asked Charlie to stop or she will make a complaint, however, he continues to behave in this manner. Jenny is still considering making a complaint to the manager about this behaviour.

Jenny has French heritage, and still speaks with an accent. However, this is no barrier to her communication skills, and no supplier or customer which Jenny has had contact with, has ever complained of misunderstanding her.

One day in the company lunchroom, Charlie again put his arm around Jennys waist and this time, kissed her on the cheek, saying, How about dinner tomorrow night? Jenny was furious, says, Leave me alone!, left the lunchroom and walked straight to Gregs office.

Jenny knocked on the managers door and Greg motioned her to come in. She closed the office door, sat down and said, I want to make a complaint about Charlies behaviour he constantly sexually harasses me and refuses to stop when I ask him. Greg instantly stood up and shouted, My cousin Charlie is a good guy and he would never do that! Ive been meaning to tell you this, but none of our customers or suppliers can understand you because of your stupid French accent! Im not interested in your complaint, in fact, youre fired! Leave now or Ill call the police! Greg then showed Jenny the door.

Jenny left the office in tears, and has become very depressed. She has been diagnosed with post-traumatic stress disorder and her doctor says she will not be fit for work for at least 6 months.

Advise Jenny if she can pursue any legal action against Charlie, Greg, and/or Queensland Films Pty Ltd (QF) under the Anti-Discrimination Act 1991 (Qld) and common law.
