Young Talents Academy is a private School located at No 2/4 Bello Close, off Ahmadu Belo Expressway in Wuse 11, Abuja. Adamu is a trailer driver employed by Tijani Transport Ltd whose main business is the delivery of cement to customers within the FCT. On January 2, 2020, the trailer driven by Adamu broke down as he was negotiating the turn into Bello Close from Ahmadu Bello Express Way in order to deliver cement at No 6 Bello Close.Because of the breakdown of the trailer, vehicle movement on the right side of Ahmadu Bello way was slightly obstructed but entry into Bello Close was totally blocked, consequent upon which staff and students of Young Talents Academy could only access the school by trekking from the Ahmadu Bello Express junction into Bello Close for a period of one week before the repairs of trailer was completed.

[i] You have been engaged as Counsel to Young Talents Academy who has requested for a legal opinion as to what legal action could be taken against Tijanni Transport Ltd and or Adamu for the obstruction of Bello Close and part of Ahmadu Bello way outlining your reasons supported by case law.

this is a law of tort question a trailer broke down by a close to a school and it was obstructing the students from getting to school directly until the trailer is fixed so the school wants to sue the transport company that owns the trailer. would the school succeed with this action if yes give reasons
