Your client is rents office space in a commercial building. She has told you that she is experiencing the following problems: i) Last month, your client had not paid her rent by the 8th of the month. When she got work on the morning of the 8th, the office door was standing wide open. Upon walking into her office, she noticed that some of her office furniture was missing. She went to talk to the building manager about what had happened and he told her that as she had not paid her rent, he had gone into her office and had taken those items as security for the arrear rental. He (the building manager) also told her that she had until the 10th to pay up, otherwise they would be holding a jumble sale in order to sell those goods. ii) Your client wishes to sub-let her office as she is fed up with all the problems that she is experiencing. She is not sure what her rights are in this regard and is worried that she will be held liable for the rent in the event that the sub-lessee does not pay their rent. You are required to advise your client with respect to her rights in terms of each of the abovementioned problems. Refer to the common law as well as case law. Yes
