Your placement mentor advised you that one week prior a court order had issued against the above client of the firm. The said court order was issued by Judge Brownstone of the Superior Court of Justice (hereafter "SCJ"). The court ordered the delivery by no later than 4pm today to both the court and the self-represented Defendant, Mr. David Cameron, of:
- your client's 2020 T1 tax return; and
- an Affidavit signed by Mr. Ngozi Agujiobi confirming this is a true copy of his 2020 T1 Tax Return.
At 12:30pm today, the Agujiobi v Cameron file (#17-44-1231) and two envelopes were left on your office desk. Each envelope purports to contain the two (2) documents required pursuant to the court order; one envelope was addressed for delivery to Mr. David Cameron and one envelope was address to the SCJ location. The file contents indicate:
Mr. Ngozi Agujiobi
(personal tel) 416-555-1212
(office tel) 416-555-1111
(fax) 416-555-1313
(address) 40 Sheppard Avenue West, Toronto, ON M5A 1H1
Mr. David Cameron
(tel) 416-555-1414
(fax) 416-555-1515
(address) 40 Main Street, Unionville, ON L5B 2M9
On top of the Agujiobi v Cameron file (#17-44-1231), your mentor has left you a memo stating that she has given you sole responsibility by no later than 4pm on March 10, 2022, to deliver to Mr. David Cameron and to file with the SCJ court administrative office the respective envelopes, each envelope contains the required two (2) documents. In the note, your mentor also states that any failure to deliver these materials on time will result in the client firing your law firm, a $500 breach of court order costs award against your client, and you being fired from your job. Your mentor also states in the note that our client is a workaholic, who is sophisticated and demanding and he will be waiting at his office to receive confirmation from you of delivery and filing of the subject documents before 4:30pm today. The note ends with a request that you provide your mentor a same day memo indicating that you successfully completed the tasks as assigned.
Due to ongoing road construction throughout the shaded area shown below, road detours take 1 hour of travel time to get from the law firm office to the SCJ location; it takes 1 hour of travel time to get from the law firm office to the office of David Cameron; and it takes 2 hours of travel time between the SCJ location and David Cameron's location.You are prohibited from driving in any of the shaded construction area. Your worst nightmare comes true today,
- The electronic CASELINES filing system used by the SCJ court is not working and the office fax system is not working, you realize you must personally get to both the court AND Mr. David Cameron's office before 4pm today, you have only 3.5hrs to accomplish both tasks;
- Everyone has left the office early because it is the Friday before the long weekend; there is no one remaining at the office that you can call to help you;
- After driving for one (1) hour today, you successfully personally deliver the envelope addressed to David Cameron. Subsequently, while you are one (1) hour into your drive westward to the SCJ location, you receive a call from Mr. Cameron advising that his envelope is missing the required Affidavit from Mr. Agujiobi. You immediately pull over your car and open the envelope addressed to the SCJ and realize the SCJ envelope contains Mr. Agujiobi's copy of his 2020 T1 tax return but is missing the necessary Affidavit signed by Mr. Agujiobi. Unless the SCJ envelope contains both required documents, the SCJ court office will not accept the filing of only this one document.
Detail in a memorandum to your mentor how you successfully resolved the above situation.
