Your text talks about Therapeutic Use Exemptions (TUE) and how they play a role in modern drug testing. You've also read a portion of the Major League Baseball Joint Drug Prevention and Treatment Program regarding these exemptions.
Assume you work as a paralegal for a big-time sports agency (yay!) and one of your clients, major league baseball player Chris Bevis, has an issue.
Bevis is a slugging first baseman for the Baltimore Orioles. Bevis is entering the last year of his rookie contract and is hoping for a big payday at the end of the upcoming season. His problem: he sucks. Or rather, he had a horrible time at the plate, sustained an abysmal batting average, and was frequently pinch hit for (a sign that the manager doesn't think much of your skill with a bat).
Bevis was recently in the office to discuss the upcoming season and the plan for future contract negotiations. Both Bevis and the agency agree that he needs to improve at the plate, but he wants to do so legally. Bevis confided that he had a hard time remaining focused at the plate and is concerned that his childhood diagnosis of ADHD (Attention-deficit/hyperactivity disorder) is causing him to lose that focus. Bevis says that he'd been prescribed Adderall (a stimulant that contains amphetamine) in high school, but stopped taking it after he was drafted by the Orioles, because Adderall is a banned substance under MLB's drug testing policy.
In a fit of brilliance, you realize that Chris might benefit from a TUE. You tell your attorney about the process and his only response is a blank stare. He doesn't understand and asks you to explain the ins and outs of the process via an inter-office memorandum.
Your assignment:
- Review the policy as outlined on pages 20-23 of the MLB Joint Drug Prevention and Treatment Program
- Draft a memo to your attorney outlining how the policy works
- include what will be required of Bevis to:
