During the Covid -19 pandemic, however, Yulia has been forced to reduce her fee. She now typically gets only about $3,000 per event.

One day, Yulia was negotiating to provide food services for a high school graduation party. Angela was about to graduate from high school and Angela's parents took Yulia out for a dinner to discuss details and negotiate price. Yulia consumed two bottles of soju by herself. When she got up to use the bathroom during dinner, she could not walk straight because of the soju, and she could not talk clearly during dinner. Angela's parents noticed this.

Yulia was really drunk, but she decided to make a written contract and book Angela's graduation party. The contract to cater (provide food services) was for $3,000, which was the same amount Yulia had been charging for about the last 18 months since the pandemic reduced business. Angela's graduation party was to take place three months in future. Yulia and Angela's parents all agreed to the contract.

The following week, Yulia coincidentally ran into Angela's parent in the neighbourhood. Angela's parents told Yulia how excited they were to have Yulia provide delicious food for the party. Yulia did not remember the agreement about Angela's party but thought that the price was fair given the market conditions with Covid- 19 harming Yulia's business. Later, Yulia checked her records and saw a copy of the agreement. She thought the deal was reasonable.

About three weeks later, the government of BC announced that due the high vaccination and low Covid infection rates, all public health restrictions would be lifted, and special events could take place with larger crowds. As a result, there was a very high demand for Yulia's catering, and someone else offered Yulia $10,000 to cater an event scheduled on the same day as Angela's graduation party. Yulia decided to book the new event because it was so much more money.

Yulia sent Angela's parents an email telling them the deal to cater the party was cancelled because Yulia was too drunk at the time of agreement. Angela's parents decide to sue Yulia for breach of contract.

If this case went to court, would Yulia be able to avoid contractual liability to Angela's parents due to her drunkenness? Explain, using the IRAC format (20 marks).
