The University of California Medical Center admitted Tunkl as a patient. While under sedation and unable to read, Tunkl was required, as a condition for admission, to sign a document containing a clause releasing the hospital from any and all liability for the negligent or wrongful acts of its employees. Alleging personal injuries from the negligence of two physicians at the Medical Center, Tunkl sued the hospital for damages.
