What does the plaintiff (patient’s family) have to prove?

Following the death of a patient who had received the wrong medication, the patient’s family sued the hospital, the physician who ordered the medication, and the nurse who administered the medication. The nurse is very concerned and agrees to legal representation from the hospital attorneys. Weeks go by before she hears from the attorney.
