Question: The legislature of the state of Kentucky was unhappy with the national auto- mobile emissions standards set by the EPA. It passed a statute setting a different standard. Is it allowed to do that under the Clean Air Act? Strategy: There is one circumstance under which states may set a different standard. Result: Kentucky does not have the right to create its own standards but, if the EPA gives California a waiver to set tougher standards than those set nationally by the EPA, other states have the right to adopt the California version.
