Privacy for cell phone users has been under scrutiny by the Fair Trade Commission for several years. The five principles the F.T.C. has set forth typically are for internet usage and privacy, but have been extended for cell phone information. The GPS technology is currently seen as an option for the consumer, not necessarily an option for phone companies and other entities to use for marketing or selling purposes. The F.T.C. has requested a feature that allows each consumer to choose their own privacy, and if they are monitored.
The indiscriminate monitoring is against the F.T.C regulations if there is no notice, consent, access, or integrity with this action. Most companies place all this information in their contract, or agreement, that the consumer has to sign in order to receive service. With that consent, these companies are acting within their companies’ rights to monitor. If they sell the information, or use it with malicious intent, then they are in violation of the F.T.C. regulations.
