1. According to section 51 of the Sale of Beverages Act 2018 (ctitious), the Minister of Domestic Trade and Consumer Affairs is empowered to make regulations on the sale, manufacturing, distribution, advertisement, import, and export of beverages in Malaysia. Pursuant to the Act, the Minister makes the following regulations: a. Regulation 4 Advertisement of sugary drinks are banned from printed publication, television, and radio due to the Ministry of Health's concern on diabetes rate in Malaysia. A penalty of RM1 million will be imposed to those who violates the law. b. Regulation 7 Application to import beverages is limited to Bumiputera only. 0. Regulation 8 Manufacturers of beverages are required to be licensed. Such license needs to be renewed on monthly basis for RM3,000 per factory. The Act requires the regulations to be laid before the Parliament, but it was not done so. Chong, a Malaysian of Chinese descent who is also an owner of a beverage company, Manis Drink Sdn Bhd is dissatisfied with the said regulations. Discuss whether Chong can challenge the regulations in court. (10 marks)
