He drove a company owned 2018 powder blue and pink striped Ford Step Van with a big company logo painted on each side. It was a stormy, wintry day in Michigan as Archie was out on his delivery route. He swerved to miss a pot hole, but went over a curb and hit Abigail, a bicyclist, knocking her off her bike causing a minor injury to her but totaling her bike. Archie immediately stopped; the police were called; and Archie made the requisite report. Archie called work and informed the boss, whereupon the boss told Archie to abandon the rest of his deliveries for the day and report directly back to the garage at company headquarters. Archie was miffed. He believed that he would be fired for sure even though he believed it would be unjust.

Low and behold, on his 4-mile, out-of-the-way trip to get the sofa, Archie hit a different pothole dead center, and the back doors of the truck popped open allowing carts containing trays of bread to fall out onto the car behind him, causing the cars air bag to activate. The driver, Adalberto, was stunned, but not seriously hurt, but the damage to the car and replacement of the air bag would cost approximately $6000.00. Assume that Archie will be liable to for the cost of damages, but he has little money to pay any damages.
