1) When deciding a legal case(a criminal case for our purposes here, we will discuss the difference between criminal and civil soon)should the lawyers and or judge decide the cases in front of them strictly based on the facts, and relevant legal authorities, or, in the alternative, allow social and public pressure to influence their decisions?

2) Next when deciding when, where, and how the U.S. Constitution applies; should courts, judges, and lawyers take the words therein to mean what they originally meant when they where written, described as "originalist" interpretation, or should the words be taken to mean what they would mean in today's society, and by today's standards, described as the "living document" interpretation of law?
