8'2 Jennings texti p. 344, Consider Inland Steel Company applied for a permit from the EPA under the Federal Water Pollution Control Act of 1972. Although inland was granted the permit, the EPA made the permit modifiable because new standards for toxic releases and treatment were being developed. Inland filed suit, claiming the modification restriction on the permit was invalid because the EPA did not have such authority and also because inland would be subject to every technological change or discovery made during the course of the permit.
