a. Afakpanga and Afa were employed by Yientiaobiaa Remedial School to teach Physics and Biology, respectively. The two were to be on probation for two (2) years before they could be fully appointed by the terms of their employment letter. Similarly, Tugar and Bruno, were engaged by the school charged with the responsibility of keeping the compound and classrooms clean. After the period of probation, the school authorities informed Afakpanga and Afa that the school was not interested in giving them permanent appointments because of unsatisfactory performance. On the other hand, Tugar and Bruno had their appointment terminated without any reason. The four (4) workers intend to take legal action against the school for compensation, accusing it of unfairly terminating their respective appointments. You are required to advise them.

b. Bondzie, a businessman, who had a contract to supply timber logs to Tommy Ltd, hired a tractor from Maricurz, at a rate of GH3,000.00 a day to enable him haul the timber logs from his timber concession in Tommy Under the agreement, Bondzie paid a deposit of GH30,000.00. It is the case of Bondzie that Maricruz assured him that her tractor was in good condition and could haul at least 15 logs a day. Bondzie, however, found the tractor to be defective almost from the beginning, with the tractor hauling a maximum of two (2) logs a day, and a total of 30 logs during a period of a little over two weeks. Bondzie brought an action for damages for breach of contract. The Court awarded Bondzie special damages of GH60,000.00 on the basis of total failure of consideration.

(i) Provide a justification of whether in the circumstance of the case, there was either a breach of condition of the contract or a breach of warranty.

(ii) Explain in THREE (3) ways whether the court was justified in the award of GH60,000.00 to Bondzie for the failure of consideration.

Opanka Chemists is the only pharmaceuticals in the Dawhenya and Mr. Efeefee is one of the key Pharmacists who had worked with the company for a decade with special skills which can only be used at Opanka. His net monthly salary was GH65,000 and he always goes to Tema to spend the weekends with his family. On 17th April 2020, during a staff meeting, the new head Pharmacist Dr. Osafo announced Mr. Efeefee's dismissal with immediate effect for insubordination. Mr. Efeefee is deeply hurt and embarrassed by the action of Dr. Osafo.
