A contract for sale of real estate described the property as follows:

Property of Greene D. Spillman located at Spillman, La., in Sections 48 and 49, T1S, R2W, West Feliciana Parish, La., and improvements. Bounded on the North by lands of Merrick, on the South by lands of Thoms and heirs of C. H. Bickham, on the East by Hwy. 967 and on the West by Mills Creek. The grounds measuring about 275 acres as per title for the sum of Sixty Thousand, Five Hundred Dollars.

Engquist signed a contract to purchase this property. A survey indicated that the farm contained only 223.64 acres. When Engquist refused to perform, the owner sued for breach of contract. Adams v. Spillman.
