According to all of the officers who responded to the scene on the day of the murder, the accused was sitting next to the body of his neighbor, staring into space looking just over him. The victim's body was covered with marks and cuts and bruises, as if he had been beaten severely. The 911 call recording painted a picture of an elderly man, distraught and desperate for the police and medics to get to the scene to "help his dear friend." It was, in fact, as if the accused had no idea he was involved in the beating in any way. The confusion over what, exactly, happened still continues on some levels, although it was apparent as soon as the officers arrived at the scene that the elderly man must surely have killed his neighbor. (The golf club he used to beat him was still clenched tightly in his hands, the blood of his neighbor all over the end of it.) What is still to consider, however, is whether the accused may have been legally insane at the time of the offense. Let's review a few concepts before you make a decision about this case.
