According to FindLaw (2017), Legal research is "the process of finding an answer to a legalquestion or checking for legal precedent that can be cited". The legal researcher uses theinformation found, which is primary law (statutes, regulations and caselaw) and secondarysources (legal digests, treatises and journals), to create the memorandum of law that summarizesthe case and provides the attorney with an analysis of the facts of the case and a direction thatcan be taken to argue the case for the client.Legal research is critical to the creation of a proper memorandum of law because the researchdetermines if the cases, statutes or regulations that are found are current; if they are not, theresearcher must look for the accepted, modified or more recent law. Current law is the mostdesired form of law. Law that is outdated would be detrimental and could cause the attorneyembarrassment and shame or even the loss of the case.A legal researcher should avoid using outdated caselaw or law that has been rejected oroverturned. Legal researchers should not begin researching without having a plan; to researchwithout a plan is like shooting while blindfolded. Another pitfall that legal researchers encounteris trying to conduct research without understanding the assignment (Glassmeyer, 2019). Notbeing organized is another pitfall that legal researchers face. If the research is not organized, theresearch will take much longer than necessary and information could become lost in the shuffle
