WRITING ASSIGNMENT Facts: Your boss, Harry Winn, Missouri Bar #11111, of the Law Firm of WE ALWAYS WIN P.C., 1234 Main Street, Clayton, Missouri 63105, wegetmoneylaw.com, has just given you the following Assignment. A lawsuit was filed last week, Cause No. 56723, by Sandra J. Jones against Ralph Russell, his new client, for a Negligence cause of action arising out of an automobile collision in which Sandra claims that Ralph rear-ended her when he was driving on St. Charles Rock Road as she was sitting in traffic waiting to make a left turn in October of 2023. Sandra claims she suffered multiple physical injuries and her car was totaled as Ralph was not paying attention. Sandra also claims in her Petition For Negligence that Ralph is a deadbeat as he refused to give her $50,000.00 at the scene of the accident and that he is a "lousy and dangerous driver" and that he is "fat and ugly" and no one would ever date him. The case has been properly filed in St. Louis County Circuit Court. Your Assignment This Assignment is one third of your grade this Semester so proceed with care. You will need to research and read the Missouri Supreme Court Rule applicable to a MOTION TO STRIKE. Remember, a Motion is drafted to bring a matter before the Court with all Parties to the litigation present at a Hearing on that Motion. You do not need to draft a Notice Of Hearing (used to schedule that hearing), just a Motion To Strike using the Sample I handed out in Class and posted under "Announcements". Draft a MOTION TO STRIKE to be e-filed on behalf of Ralph. Your assignment should be typed and spaced in the proper format that I taught you. Also, you are to turn in with your Motion a copy of the proper Missouri Supreme Court Rule that supports your Motion. Note: This is not a group Assignment or for you to ask for help from the office. You will need to think of what facts you need to tell the Court, if any, for the allegations (numbered paragraphs) of your Motion
