Albert becomes the owner of a parcel of land known as Whiteacre when his uncle dies and leaves Whiteacre to Albert in his will.Whiteacre is located in a different town and ALbert has never seen the property.However, the will, which Albert has seen, describes the land as consisting of about 2 acres.Albert tells his co-worker, Brad, about the inheritance and, specifically, that it consists of 2 acres.Brad is very interested in the land because he wishes to build a vacation home on it.

Brad tells Albert that he wants a lot of land because he has planned a dream home with a swimming pool, tennis court and a garden, and will require at least 1.5 acres.Brad then buys the land, obtaining a written deed from Albert and giving Albert the purchase price of $120,000.00.

Later, Brad visits Whiteacre and discovers that Whiteacre consists of less than 1 acre, which is not enough land to build Brad's dream home.

Brad now sues Albert to get out of the contract.
