Andile is a project manager in Cape Town, however, he is very unhappy in Cape Town and with his job. He sees a vacancy advertised in the Gauteng newspaper for a project manager with much better prospects and applies for the vacancy. Andile is short-listed and receives an invitation for an interview from the interviewing committee. Andile accepts the invitation and flies to Gauteng for the interview. He pays for the travelling costs out of his own pocket. All seems to be going well during the interview process. A week later, Andile receives an email from the interviewing committee stating that his interview went extremely well and that he has an excellent chance of being offered the position. As a result of the above Andile resigns from his present job, sells his house and makes arrangements for the transportation of his furniture to Gauteng. Two days after receiving the first email from the interviewing committee, he then receives another email from the CEO of the company, apologizing, stating that the first email was supposed to be sent to another applicant and this all was a misunderstanding and a mistake.

Andile is furious and approaches you for advice, as he has heard from someone that he may have a contract and that he can/may institute a claim for contractual damages;

1)Whether the South African Law of Contract follows an objective, subjective approach or a mixture of the two (a hybrid system).

2)Apply each of the various theories found in the Law of Contract in the abovementioned scenario and discuss the outcomes of each of the existing theories.

3)You must also discuss whether these theories can be used to establish contractual liability of the various parties.
