Chapter 14, Case Problem 8- While Diane Tait and her boyfriend were spending the day at Chincoteague National Wildlife Refuge, they happened upon a large fishing boat that had run aground, half in and half out of the water. The boat was named the "Freda Marie." Witnesses testified that the boat had been in that position for several weeks. When Tait and her boyfriend came upon the boat, there were several people playing on and around the boat. Laying nearby the boat was a line of rope. Also nearby was a life preserver ring with the name "Freda Marie" on it. Tait thought the rope and life preserver were "beach junk" and would make a nice decoration in her camper. She cut a length of rope from the line and threw it and the life preserver ring into the back of her pickup truck. She was later cited for removing private property from federal land. Black's Law Dictionary defines private property as "[p]roperty...over which the owner has exclusive and absolute rights." Based on this definition, was Tait guilty of removing private property from federal land? Is there another classification of this property that might protect her from conviction? If so, what is that classification and what rights, if any, did Tait get in the rope and life preserver?
