Blessing is the Bank's Director of Finance, having joined the company 12 months ago.Her contract states that she may be dismissed with three months' notice. The contract also sets out a disciplinary procedure. Blessing has notreported large customer deposits to their internal money laundering officer in accordance with the bank's procedures, claiming that in each case they were not suspicious as she had verified the customer's identity. The Chief Executive wants to dismiss Blessing for gross misconduct but Priti is concerned that this could result in a legal challenge. Advise Priti as to the common law position if the company proceeds to dismiss Blessing

Due to the difficult economic conditions the Bank intends to make 200 staff redundant. In the next three months it wants to lose 25 managers, 75 customer advisors and 100 bank tellers. In the past the company has selected candidates for redundancy based on length of service, attendance record and customer feedback. The Chief Executive would like to use these criteria again but Priti is concerned that these are not suitable criteria. She has asked for your advice as to the correct redundancy dismissal procedure and the risks of failing to follow the correct process.The Bank recognises the Banking and Building Society Trade Union.
