As a paralegal, you are looking for employment. You interview and are offered a job with Smith and Smith. The compensation is $40,000 annually with benefits. The offer letter states that once you accept, employment will start 60 days from the date of your acceptance. Within the 60 days, you hear that the law firm of Smith and Smith is dissolving due to an economic downturn in their business. Many of their clients have gone bankrupt. Although you have not heard anything from the partner that hired you, you are worried, so you begin interviewing again. Holland and Forbes offer you a job, which you accept. You begin immediately. After working for two weeks, the partner from Smith and Smith calls you and tells you to contact personnel so that they can begin establishing your personal file. You are shocked. You tell the partner you have accepted another job with another firm. The partner is not happy and states that he will see you in court. Have you breached the contract with Smith and Smith? Would your response change if Smith and Smith withdrew their offer after you accepted the contract? If so, why?
