ASSIGNMENT INSTRUCTIONS

Background facts:

After graduating from your business degree at Central Queensland University you recently commenced working at a professional consulting services firm called "Consulting Squared" in the State or Territory in which you are undertaking your studies. You work in the legal compliance team and utilise your knowledge of commerce and law acquired from LAWS20059 to advise a diverse range of clients. You specialise in advising clients on how Australian law governs business structures in the operation of commercial activities.

Your supervisor, Elizabeth, wants you to write a report about an Australian business (which you need to choose, as per the instructions below), so she can use the report at the forthcoming 2021 "Business in Oz" Conference (where she will be presenting on choosing a business structure for a business in the hope of attracting new clients to the firm). You must write a report as instructed by your supervisor (instructions are below).

PART 1 - THE BUSINESS [5 marks]

In Part 1 you must choose an Australian business to write about in your report. This may be a business which you use regularly whilst in Australia, or which you have heard about. Your supervisor, Elizabeth, wants you to write a report which:

summarises the chosen business (including its trading name, location, how and why it is used by people, etc); and

identifies the business structure which is used by the business, based on freely available information about the business on the Australian Government's Australian Business Register < https://abr.business.gov.au/> and/or ASIC Connect < https://connectonline.asic.gov.au/>.

PART 2 - IDENTIFY AND EXPLAIN BUSINESS STRUCTURES USED IN AUSTRALIA [15 marks]

In Part 2 you must explain each of the main business structures used in Australia and the key differences between them. Elizabeth wants you to write a report which:

identifies the main business structures which are used in Australia; and

describes each of these business structures, and the key legal differences between the business structures. She wants to know the key features of each business structure and the main legal benefits and disadvantages of using each business structure.

PART 3 - ADVISE WHETHER THE BUSINESS IS USING THE MOST APPROPRIATE BUSINESS STRUCTURE [10 marks]

In Part 3 you must evaluate each business structure which you explained in Part 2 of the report to provide advice. In this part of the report you must advise whether the chosen business is using the most appropriate business structure. (If you think the business is using the most appropriate business structure, you must explain why. If you think another business structure is more appropriate for the business, you must explain why). You are expected to use information which you gained from your research of the chosen business and its industry to weigh up the various business structures and assess which business structure is best for the chosen business, so that Elizabeth has a useful case study to share about choosing a business structure at the conference.
