Ausaf Umar Siddiqui, a computer salesman at Fry's Electronics who worked his way up to vice president of merchandising and operations at Fry's, has been charged with receiving $65 million in kickbacks from vendors. The indictment alleges that vendors agreed to pay as much as 31 percent commission to Siddiqui in exchange for his promise to buy merchandise from them at inflated prices. The commissions he received were then paid to a company called PC International LLC. According to the IRS, the money was used to pay off gambling debts Siddiqui owed to Las Vegas casinos. Fry's has fired Siddiqui, and his coworkers at Fry's were stunned when he was arrested at work. He was released on $300, 000 bond with the stipulation that he not travel to Las Vegas. The charges came when the IRS received an anonymous up from an upper-level manager at Fry's whose tip included copies of spreadsheets showing the payments from vendors. The anonymous tipper said that he had stumbled across the documents when he made an unannounced visit to Siddiqui's office. Vendors included U.S. Media Technology. Elitegroup Company Computer Services, Inc., Phoebe Micro, and Lead Data International, Inc. The commissions paid were 10 times the normal amounts and were sent to Siddiqui's home in Palo Alto The IRS review of Siddiqui's bank account set up for the commissions shows that $167 million was deposited in the account during the past three year, something that leads investigators to believe that they have not uncovered all the vendors or payments. What are the duties of an agent with respect to commissions earned? What ethical issues exists here? Is this commercial bribery? Could the vendors be charged? If the vendors can be charged, what type of charges would they face? why do we worry about this type of conduct by an agent? Discuss the agency issues relevant to this case? What would be an appropriate punishment for Mr. Siddiqui upon conviction? Jail? fines? restitution? Discuss
