Background: Over the past three decades, the Western democracies (U.S., EU, Canada, etc.) have spear-headed the adoption of western standards for intellectual property protection across the developing world through TRIPS and the WIPO. They have achieved this objective by offering increased access to international trade through the WTO as a carrot for developing nations, while simultaneously forcing the adoption of enhanced IP protection standards by developing nations as a requirement for granting access to increased trade opportunities. Many observers believe that the Western democracies have been acting in a self-serving manner by using the enhanced IP protection in developing nations to ensure that the economic reward for new intellectual property ideas (which is almost exclusively created in the developed countries) are paid to Western-based companies. The observers argue that this entrenches the economic dominance of the developed nations to the detriment of developing countries, and also creates artificial scarcity in the developing nations by preventing them from accessing important IP (such as COVID vaccines or treatments) that they cannot afford to pay for at market prices. 4 The Question: BE IT RESOLVED that the Western democracies should change their positions on international IP protection such that they force all companies based in developed nations to grant developing nations licenses on their IP ensuring the ability to use Western-based intellectual property free of charge, or at a significantly reduced cost, thereby allowing the developing nations to catch up economically with the developed world and become more prosperous.
