We represent Joe and Ann Wright, and their son, Bob Wright. Last semester, Bob was a freshman at the State University of Georgia at Zebulon. Bob lived in Smith, a freshman dormitory at the school, and he wanted to be involved in school activities. The State University of Georgia at Zebulon supported intramural sports activities, including soccer, in which Smith dorm students competed against students living in other dormitories on campus. Bob was not very athletic, and Smith lost all its soccer matches because of Bob's lack of skill. As a defensive player, he often got in the way of his team. After a 0-4 record, Bob's teammates physically threatened him and told him to quit. Bob notified Smith Dormitory Director of Residents' Life, Jason Mitchell, who took no action except to tell the other players that Bob could continue to play, and they could not make him quit. After two more losses, Bob was told by the other players he could continue to play if he went through a training program in the basement of Smith. At the "training program", Bob was beaten by his teammates, and a fifth of vodka was poured down his throat. Bob, a diabetic, had his arm broken, received fifty stitches to his torso and was hospitalized for ten days due to complications the alcohol caused to his diabetes. Bob subsequently withdrew from the school. Bob and his parents want to sue the State University of Georgia at Zebulon and Jason Mitchell under Georgia's anti-hazing statute, O.C.G.A. 16-5-61.

Although I am certain Bob was hazed under the meaning of O.C.G.A. 16-5-61 (https://law.justia.com/codes/georgia/2022/title-16/chapter-5/article-4/section-16-5-61/), I remember working on a case several years ago in which the reasoning of the case may shield the State University of Georgia at Zebulon and Jason Mitchell from being held liable. I believe the name of that case was Pelham v. Board of Regents of the University System of Georgia.
