Case:

John went to buy a computer and a warranty that covers his computer. He made known to the salesman that he was computer illiterate.

The salesman recommends him a computer and 3 year warranty that he can purchase.

The salesman says "This warranty covers parts, transport and labours. All you have to do is call this number XXXXXXX, and the staffs will come to your home right away to fix the problem.". After hearing how simple this was, John relied on the salesman words and purchase the warranty and computer.

A year later, his computer has a software issue. He calls the number XXXXXXX but the staff answered saying "The warranty covers only hardware issues not software. Also, before you use the warranty, you must activate it through a simple diagnostic phone call.".

John was furious and got the computer repaired elsewhere. Now, he wish to claim damages and terminate the contract. He believe that the company has misrepresent the terms to him and induced him to enter the contract.
